Arezzo. Da omicidio volontario a omicidio colposo. Così la Corte d'Assise di Arezzo ha derubricato il reato attribuito all'agente Luigi Spaccarotella, condannato a sei anni di reclusione con l'accusa di aver ucciso con un colpo di pistola il tifoso laziale Gabriele Sandri nell'area di servizio dell'A1 di Badia al Pino l'11 novembre 2007. Al reato il Tribunale di Arezzo ha aggiunto l'aggravante della «colpa cosciente», cioè della previsione dell'evento senza però averlo voluto. Secondo la Corte di Assise, quel giorno, nell'area di servizio di Badia al Pino, Spaccarotella avrebbe ucciso accidentalmente il giovane tifoso della Lazio. Alla lettura del dispositivo hanno fatto seguito le urla e le proteste dei parenti e degli amici di Gabriele Sandri, delusi da quanto deliberato dai giudici. «Adesso me lo 
hanno ammazzato una seconda volta. Come fai a credere nella giustizia? Adesso non ci credi più», ha affermato la madre di Gabriele, Daniela Sandri, mentre il padre del giovane tifoso laziale ha commentato la sentenza definendola «una vergogna per tutta l'Italia». E in preda a un dolore che difficilmente potrà cessare ha continuato: «Non sono bastati cinque testimoni che hanno visto quello che ha fatto l'individuo, quando basta un pentito di mafia per mandare gente all'ergastolo per 30 anni. Evidentemente la divisa ha il suo peso. Mi vergogno di essere italiano, mi vergogno di aver creduto nella giustizia. Per fortuna che c'è la giustizia divina che penserà a Spaccarotella, a quella non potrà sfuggire senz'altro». Una trentina di amici di Gabriele, alcuni dei quali sono perfino svenuti e hanno 
accusato malori, si sono radunati sul piazzale antistante il Tribunale di Arezzo. Qualcuno, accecato dalla rabbia, ha inveito contro Spaccarotella e contro i giudici, ma è stato presto calmato dal fratello di Sandri, che lo ha ammonito dicendo di non rischiare di uccidere Gabriele per la terza volta.La sentenza della Corte di Assise è arrivata a quattro mesi dall'avvio del processo, aperto il 20 marzo. La giuria si era riunita in Camera di Consiglio alle 11.30, dopo le repliche e le controrepliche della mattinata. Il pubblico ministero, Giuseppe Ledda, aveva chiesto 14 anni per omicidio volontario con dolo eventuale, con le attenuanti generiche per lo sconto di un terzo della pena.
Spaccarotella: «Ho pianto di gioia» - L'agente Spaccarotella, al telefono con il proprio avvocato, Federico Bagattini, si è detto felice dell'esito del processo. Anche Bagattini si è detto molto soddisfatto del risultato ottenuto che, pena a parte, ha permesso alla difesa di ottenere che il reato di cui è accusato l'agente venisse riconosciuto come omicidio colposo. «Ovviamente la pena è molto gravosa, troppo eccessiva, e su questo punto faremo appello. Intanto usciamo dall'omicidio volontario, che evidentemente è il risultato al quale tendevamo» ha affermato Bagattini.
